Part A: General
A1. This agreement is between Artefact Group Pty Ltd (ACN 661 296 715), trading as AdmitMe (“AdmitMe”, “we”, “us”), and the person or organisation placing the order (“you”). You accept it when you tick the box at checkout, pay for an order or sign a quote that refers to it. A signed quote takes priority over these terms where they differ.
A2. The equipment is the devices we supply (rugged handheld scanners and POS terminals with a built-in printer) with their batteries, chargers, cables, cases and packaging.
A3. We supply equipment for business and event use, for delivery within Australia only.
A4. Prices are in Australian dollars and include GST. Prices are confirmed at checkout or in your quote. At the date of these terms they are:
| Handheld scanner | POS terminal | |
|---|---|---|
| Hire per event, up to 5 days | A$195 | A$145 |
| Each extra day, and each late day | A$25 | A$20 |
| Buy | A$1,095 | A$795 |
| Replacement fee (lost or not returned) | A$595 | A$395 |
Courier for a hire is A$59 for each box of up to 10 devices, both ways with a return label. Courier for a purchase is A$29 a box. Pickup at the event is free where we have offered it for that event.
A5. Payment. You pay the full order price by card when you book, on a secure Stripe payment page. Leases are paid as set out in Part D. We never see or store your card number.
A6. Saved card. For a hire or a lease, Stripe saves your card so we can charge the late-return, damage and replacement charges in Part B, and nothing else. We email you with the amount and the reason at least 2 business days before we charge it, so you can query it first.
A7. Software. Devices come with AdmitMe Capture installed. Using it needs an AdmitMe account or a sponsor seat, under our platform terms. Lead data you capture is stored in your AdmitMe account, not only on the device.
Part B: Hire
Booking and delivery
B1. The hire period runs from the start date to the end date you book. The hire price covers up to 5 days; each day after that is charged at the extra-day rate. The longest hire is 30 days. For longer, see Part D.
B2. Courier bookings need a start date at least 7 days after you book, and pickup bookings at least 3 days. Courier deliveries arrive before your start date. Pickup devices are at the AdmitMe desk at the event.
B3. Devices arrive set up, charged, and with a charger and cable. Check them when they arrive and tell us within 24 hours, through the support form, if anything is missing or not working. We will replace a faulty device as fast as we can, or refund its hire.
Looking after the equipment
B4. The equipment stays ours. While it is with you, you must:
- use it only for your event, in line with our instructions, and keep it in Australia;
- keep it secure and protected from water beyond its rating, extreme heat, drops and theft;
- not sell, lend, sub-hire or give it as security to anyone else, other than handing it to your own staff, volunteers or exhibitors to use at the event;
- not open, repair, modify, root or reset it, remove labels, or install other software on it; and
- tell us within 24 hours if any of it is lost, stolen or damaged, and report a theft to the police and give us the report number.
B5. You are responsible for the equipment from when it is delivered to you (or collected by you) until we receive it back. We recommend your insurance covers hired equipment.
Returning it
B6. Courier hire: pack the equipment in the box it came in and drop it off with the prepaid return label within 2 days after your end date. Pickup hire: hand it back at the AdmitMe desk before you leave the event.
B7. Before returning a device, make sure your leads have synced to your account (the app shows this). We wipe and reset every device when it comes back, so anything left on it is deleted.
Charges after the hire
B8. Late return: for each day after the return date until the equipment is handed to the courier or to us, at the extra-day rate per device.
B9. Damage: damage beyond normal wear and tear is charged at the reasonable cost of repair, up to the replacement fee for that device. A missing charger, cable or case is charged at our cost to replace it. We send you photos and the repair cost with our notice.
B10. Not returned: a device not returned within 14 days of the end date is charged the replacement fee, along with late days up to that point. If you then return it in working order within 30 days of being charged, we refund the replacement fee, less late days and any damage charge.
B11. We do not charge you for faults that are not caused by you, or for damage caused by us or our courier.
Cancelling a hire
B12. If you cancel more than 7 days before the start date, we refund the order in full. If you cancel within 7 days of the start date, we refund 50% of the hire price and the full courier charge, provided the equipment has not yet been sent.
B13. If the event itself is cancelled by its organiser, we refund the order in full, less the outbound courier charge if the equipment has already been sent.
B14. If we cannot supply the equipment you booked, we will tell you as soon as we know and refund you in full.
Seat + handheld
B15. A seat + handheld booking is a lead scanning seat for one event plus the hire of one handheld for that event. The seat is covered by our platform terms and the handheld by this Part B.
Part C: Purchase
C1. When you buy equipment, it becomes yours once we have received payment in full. It is your responsibility from when it is delivered.
C2. 30-day return. You can return equipment that is unused, undamaged and in its original packaging within 30 days of delivery for a refund of the price. Tell us through the support form first. You pay the cost of sending it back, unless it is faulty.
C3. 12-month warranty. We warrant that equipment you buy from us will be free from defects in materials and workmanship for 12 months from delivery. If it is not, we will repair or replace it, or, if we cannot, refund the price. The warranty does not cover damage from accidents, misuse, water beyond the device’s rating, unauthorised repair or modification, or normal wear, such as battery capacity reducing over time.
C4. Making a warranty claim. Contact us within the warranty period through the support form, by email to support@artefactgroup.au or by phone on 07 2141 6461, with your order reference and a description of the fault. We will send you a prepaid label, and we pay the reasonable cost of sending the device to us and back to you. The warranty is given by Artefact Group Pty Ltd (ACN 661 296 715) trading as AdmitMe, Brisbane, Queensland.
C5. The benefits of this warranty are in addition to other rights and remedies you have under a law in relation to the goods to which the warranty relates.
C6. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
C7. Repairs may use refurbished parts, and a replacement may be a refurbished device of the same or a better model. Back up anything on a device before sending it for repair, because repair may delete it.
Part D: Lease
D1. A lease is a longer-term rental of equipment for 3 months or more, for example a fleet for a venue, a season or a series of events. Every lease is set out in a written quote that states the equipment, the monthly price, the minimum term and the start date.
D2. Payment. The monthly price is paid in advance, by card each month or by invoice payable within 7 days, as the quote says.
D3. Term. After the minimum term, the lease continues month to month until either party gives 30 days’ written notice. If you end the lease before the minimum term ends, the monthly payments for the rest of the minimum term become payable, less any amount we save by hiring the equipment to someone else.
D4. Faults and swaps. If leased equipment develops a fault you did not cause, we repair or replace it at no charge, and aim to send a replacement within 3 business days.
D5. Part B clauses B4 to B11 (looking after, returning and charges) apply to leased equipment, with the return date being the end of the lease.
D6. Option to buy. Where the quote includes an option to buy, you may buy the equipment at the end of the lease for the amount stated in the quote.
D7. Personal property securities. A lease may be a “PPS lease” under the Personal Property Securities Act 2009 (Cth) (“PPSA”). You agree that we may register our interest in the equipment on the Personal Property Securities Register, and you will give us any information we reasonably need to do so. To the extent the law allows, you waive your right to receive a verification statement, and the parties agree that sections 95, 118, 121(4), 125, 130, 132(3)(d), 132(4), 142 and 143 of the PPSA do not apply. We will remove our registration when the lease ends and the equipment is returned or bought.
Part E: Liability and general
E1. Nothing in this agreement excludes, restricts or modifies any right or remedy, or any guarantee, that cannot be excluded under the Australian Consumer Law or other law.
E2. Where the law lets us limit our liability for a breach of a consumer guarantee, our liability is limited, at our choice, to repairing or replacing the equipment, supplying equivalent equipment, or paying the cost of doing so.
E3. Otherwise, and to the extent the law allows, our total liability under this agreement is limited to the amount you paid for the order concerned, and we are not liable for loss of profit, revenue, leads or data, or for indirect or consequential loss. This does not limit our liability for personal injury or death caused by our negligence.
E4. Our liability is reduced to the extent you caused or contributed to the loss.
E5. We may change these terms for future orders. The terms in force when you place an order, or sign a lease quote, apply to it. For a lease that continues month to month, we will give you 30 days’ notice of a change that is not in your favour, and you may end the lease before it applies.
E6. We may transfer this agreement to a related body corporate or a buyer of the AdmitMe business on written notice to you, provided your rights are not reduced.
E7. This agreement is governed by the laws of Queensland. If a dispute arises, we will first try to resolve it with you in good faith. If you are a consumer, the consumer protection laws of your state or territory also apply.
E8. Questions and claims: support form, or support@artefactgroup.au.
